However, often extensive advertising of dietary supplements unobtrusively, and sometimes directly and openly offers dietary supplements as a highly effective drug for the treatment of almost all diseases, which is a deception of consumers, because A dietary supplement is not a drug.

3. It is necessary to buy dietary supplements for food ONLY in pharmacies, pharmacy stores, pharmacy kiosks, specialized stores selling dietary products, special departments, sections, kiosks of grocery stores.

  • names of dietary supplements;

  • information about its correct use;
  • information on contraindications for use in certain types of diseases;
  • an indication that the dietary supplement is not a drug;
  • date of manufacture, warranty period of validity or date of the expiration date of product sales;
  • storage conditions;
  • information on the state registration of dietary supplements, indicating the number and date;
  • location, name of the manufacturer (seller) and location and telephone number of the organization authorized by the manufacturer (seller) to accept claims from consumers.

The above information should be communicated to the consumer in any form that the consumer can read.

The use of the term "environmentally friendly product" in the name and when applying information to the label of dietary supplements, as well as the use of other terms that do not have legislative and scientific justification, is not allowed.

5. Dietary supplements in accordance with Art. 10 of the Federal Law of 02.01.2000 No. 29-FZ "On the quality and safety of food products" are subject to state registration in the manner prescribed by the Law.

6. Decree of the Government of the Russian Federation of December 1, 2009 No. 982 "On the approval of a unified list of products subject to mandatory certification ..." established a unified list of products, the conformity of which is confirmed in the form of a declaration of conformity.   • the implementation of dietary supplements is carried out strictly in accordance with SanPiN 2.3.2.1290-03 "Hygienic requirements for the organization of production and circulation of biologically active food additives (dietary supplements)" in pharmacies and specialized stores or departments of food stores selling dietary products;
  • comply with the requirements for placing information on the label, which is agreed upon during the state registration of dietary supplements;
  • not to include in the names of dietary supplements terms, and on the packaging of drawings that mislead the consumer and indicate the alleged effectiveness of dietary supplements;
  • take measures to ensure compliance with legislation in the preparation of advertising materials about dietary supplements (Resolution of the Chief State Sanitary Doctor of the Russian Federation dated 20.05.2009 No. 36 "On supervision of biologically active food additives (BAA)").

In accordance with Part 1 of Art. 25 of the Federal Law of 13.03.2006. № 38-ФЗ "On Advertising", advertising of biologically active additives and food additives should not:

  • create the impression that they are drugs and / or have medicinal properties;
  • contain links to specific cases of curing people, improving their condition as a result of the use of such additives;
  • contain an expression of gratitude to individuals in connection with the use of such additives;
  • encourage the rejection of a healthy diet;
  • create an impression of the benefits of such additives by referring to the fact that research is required for state registration of such additives, and also use the results of other studies in the form of a direct recommendation for the use of such additives.

8. Legal entities and individual entrepreneurs carrying out activities in the field of circulation of biologically active food additives are responsible for ensuring the quality of dietary supplements.

9. In accordance with the Decree of the Government of the Russian Federation of April 23, 1997. No. 481 "On approval of the list of goods, information about which must contain contraindications ..." biologically active food additives that have a tonic, hormone-like, and effect on the growth of human body tissues (concentrates of natural or identical to natural biologically active substances obtained from plant, animal or mineral raw materials) must necessarily contain information on contraindications for use in certain types of diseases.
