Assessment of workplaces held under the contract with the organizationThat should:

  • have accreditation of the Ministry of Health and Social Development of Russia and be included in the Register of Accredited Organizations, located on the official website of the Ministry of Health and Social Development;
  • to be independent towards a legal entity, on the workplace of which, according to the contract, certification is held.

Main steps

Certification can be divided into three main periods:

  • stage planning and preparation of work, including the conclusion of the contract, the formation of a certification commission and approval of its composition by order on the organization, drawing up the work schedule. During this period, the Commission examines local organizational and administrative documents, establishes harmful and dangerous factors at workplaces and determines where instrumental measurements will be held;
  • the main stage is The actual conduct of the necessary instrumentation measurements with the design of the respective protocols and preparation based on their certification cards. The certification card necessarily indicates the code of the OKVED organization, the certification of the jobs of which was carried out. If as a result of the research conducted, it was revealed that the workplace conditions do not ensure the maintenance of workers, the employer develops a number of measures to reduce the negative impact of harmful conditions for the health of working;
  • registration of final documents, the main of which are the final protocol of the Attestation Commission and a report on applements with applications. By his order, the employer completes the certification and approves the reporting materials.

Compensation, benefits, fines

The legislation of the Russian Federation is punished for violations of labor protection requirements, ranging from disciplinary and ending with criminal liability. Often the punishment is the imposition of an administrative fine, its maximum size is:

  • for persons who carry out job duties, up to five thousand rubles;
  • for organizations carrying out entrepreneurial activities with the formation of a legal entity, up to fifty thousand rubles.

Additional tariffs in the FIU and a special assessment of working conditions.

Starting January 1, 2014, employers are obliged to hold in accordance with Federal Law of December 28, 2013 No. 426-ФЗ special assessment of working conditions. According to the results of a special assessment of working conditions, classes and subclasses of working conditions are established on the basis of which the additional rate of contributions to the FIU is determined (Article 58.3 of Law No. 2112-FZ). It is necessary to keep in mind that contributions for additional tariffs are not always accrued.

To determine, charge or no contributions to the FIU on additional tariffs, it is necessary to be guided by the lists of No. 1 and No. 2 (approved. Decree of the Cabinet of Ministers of the USSR dated January 26, 1991 No. 10). If the position of an employee is contained in one of these lists, then contributions to the FIU with the use of additional tariffs are charged on its payments. If the position is not contained in any of the lists, then the obligations to impose payments to contributions to the FIU on additional tariffs does not occur. The size of the applied tariff depends on the type of work on which the employee (insured person) is occupied, as well as on the results of a special assessment of working conditions.

Tariffs for payments to employees engaged in the works contained in these lists, the following (PP. 1, 2, Article 33.2 of the Federal Law of December 15, 2001 No. 167-FZ, part 1, 2, Article 58.3 of the Federal Law of 07/24/2009 №212-ФЗ):

Persons engaged in underground work, on work with harmful working conditions and in hot shops (PP. 1, 1, Art. 27 of the Federal Law of December 17, 2001 No. 173-FZ)

2014 - 6.0% - the solidarity of the tariff

2015 - 9.0% - the solidarity of the tariff

Depending on the results of a special assessment of working conditions, the following rates of additional contributions are applied to the FIU, they are used instead of those listed above (paragraph 2.1 of Art. 33.2 of the Federal Law of December 15, 2001 No. 167-FZ, part 2.1 of Art. 58.3 of the Federal Law of 24.07. 2009 №212-ФЗ):

Contributions for additional tariffs are subject to payment:

- payments in favor of persons entitled to the early appointment of labor pension;

- Payments and remuneration in favor of the employee from the date of registration with him labor relations involving work with special working conditions. The duration of time during which the employee is directly exposed to harmful factors (daily during the estimated period or periodically, for industrial necessity), does not affect the procedure for calculating insurance premiums;

- payments in favor of an employee who has the right to early retirement, regardless of the working time mode (for example, part-time or incomplete working week);

- If the employee is already a pensioner (that is, it already receives an early pension), but continues to work with the special working conditions, the accrual of pension contributions on additional tariffs on payments to such a person continues.

Special assessment of working conditions - activity codes

1-18 tbsp. 1 of Law No. 173-FZ, the legislation of the Russian Federation on insurance premiums is not provided. Insurance premiums on additional payments for payments made in favor of employees in the workplace places of labor on the current results of job certification (or from 01/01/2014 for the results of a special assessment of working conditions) are recognized as harmful and (or) dangerous, but not Renamed in PP. 1-8 p. 1 tbsp. 27 of the Federal Law No. 173-FZ are not charged.

Reporting in the FIU

From the 1st quarter of 2014, reporting in the FIU in terms of reflection of additional contributions is clarified:

section 2 is supplemented with a new subsection 2.4, which reflects information on the underractory insurance premiums depending on the class (subclass) of working conditions, which is established according to the results of a special price;

in Section 4, the columns 3 and 13 were added, which reflect the detached preliminities paid on the basis of the results of a special price (part 2.1 of Article 58.3 of Law No. 212-ФЗ);

Reporting in FSS.

Special assessment of working conditions: OKVED code

To determine the case of a particular activity in the OKVED classification, several meaningful categories are applied. In particular, OKVED for a special assessment of working conditions is characterized by the following notation:
