Closely related to the right of authorship is the right to an author's name, the content of which is disclosed in Art. 15 of the Law of the Russian Federation "On Copyright and Related Rights". According to this article, the author may use or allow the use of the work under his real name, under a conventional name (pseudonym) or without a name (anonymously). By choosing one of these methods, the author realizes his right to a name. He also has the right to demand that his name be indicated each time his work is published, publicly performed, broadcast on the radio, quoted or otherwise used. Finally, the right to a name includes the ability to demand that the author's name (pseudonym) not be distorted when it is mentioned by persons using the work.

The right to a name is sometimes regarded as a concretization of the right of authorship180, one of the manifestations of the latter181. However, according to most researchers, we are talking about interrelated, but still completely independent rights. The rights under consideration do not coincide in scope and differ in the nature of the opportunities that they contain. This is clearly confirmed by the fact that the right to an author's name can be violated without violating the right of authorship, for example, by distorting the author's name or by violating the method chosen by the author to indicate the connection between the work and his name. In addition, unlike the right of authorship, which reflects an objective fact and does not depend on the publication of a work, the right to a name is exercised by the unilateral will of the author and is exercised in connection with the use of the work182.

The right to an author's name is a personal non-property right of the author, which the latter cannot transfer to anyone. Like the right of authorship, this right arises from the very fact of creating a work, but unlike the right of authorship, it is realized only in the case of publication of the work. As long as the work is not made public, the right in question exists only potentially, since the work is not available to third parties and they cannot find out the name of its creator. The right to a copyright name is valid throughout the life of the author, and after his death is protected by heirs, copyright organizations or the state as a public interest.

As already noted, the law indicates three possible ways in which the author exercises his right to a copyright name. Most often, the creators of works indicate their authorship by indicating their true name. The real name of the author can be placed on the title page of a book or on posters, indicated in the credits of a film or announced before the public performance of the work or its broadcast, etc. The fact that the name of a certain person is indicated on the work means the presumption that the authorship of the work belongs to this person. Although this presumption is not enshrined in law, but is factual, it reflects with sufficient certainty the actual state of affairs and is applied in practice. The author himself determines the method and completeness of the indication of his true name. In particular, the author can indicate his name in full, indicating his surname, first name and patronymic (Dotsenko Irina Ivanovna), may indicate only the first and last name (Irina Dotsenko) or surname and initials (I.I. Dotsenko), etc. .

If, however, the work is signed only with the initials (ID), such a work is considered anonymous.

When publishing works created by several persons, the names of co-authors are indicated in the sequence specified by the co-authors. All co-authors enjoy the right to indicate their name, regardless of the size of the creative contribution made to the work. However, by agreement of the creators of a collective work, it may be published under the name of one or more of them, for example, to reflect the fact that it was this person (s) who made the main creative contribution to the creation of the work. The names of other co-authors may, with their consent, be indicated in the preface or in another place of work. In the event of a dispute about the method of designating the names of co-authors, their names are arranged in alphabetical order.

When using works of foreign authors in Russia, their names are given in Russian transcription, which must be agreed with the author of the original. With this method of using a work as an edition, the names of foreign authors are often indicated in the original language on the back of the title page.

Often, especially when using scientific works in print, along with the name of the author, his scientific degree, academic or honorary title, position and other details are indicated. Bringing such information can be made only with the consent of the authors, who are personally responsible for the accuracy of the specified data.

Violation of the right to a name with this method of its implementation will be the failure to indicate the name of the author, as well as its distortion. This is a fairly typical and common violation found in the area under consideration. The right of creators of works to an author's name is most often violated during public performance of works, their broadcasting, etc. Thus, in radio and television programs, works are often heard and shown without indicating the names of their creators. This is a violation of the rights of the latter and should be suppressed by law enforcement authorities and copyright organizations. The right to a name can be violated when quoting other people's works is allowed by law, but without indicating the source of borrowing. So JI.H. Gumilyov made a well-founded claim to the journal "Our Contemporary" and V. Chivilikhin due to the fact that in the essay "Memory", which was published on the pages of the journal, citations from the scientific works of JI are widely used. N. Gumilyov without mentioning his name. According to the editors of the journal, such a reference apparatus would make it difficult for both the author's narration and the perception of the text by readers. However, the requirement of JI. N. Gumilyov was satisfied1.

The next way to designate the author's name and exercise the right in question is the performance of the author under a fictitious name (pseudonym). It is also often used in practice. Many Russian writers (Anna Akhmatova, Maxim Gorky, Demyan Bedny, etc.) entered the history of Russian and world literature under their fictitious names. Sometimes under a pseudonym there is not one person, but two, three or more co-authors. So, under the name of Kozma Prutkov, the Zhemchuzhnikov brothers and the poet A. K. Tolstoy created their works, the pseudonym “Kukryniksy” combined the names of artists M. Kupriyanov, P. Krylov and N. Sokolov, who worked in the field of fine art for a long time, etc.

In the 50s, a discussion took place in the Soviet press about the admissibility of using a pseudonym in writing and other creative activities. Supporters of the introduction of a ban on the pseudonym, among which was, in particular, the famous Soviet writer M. A. Sholokhov, did not provide any convincing arguments in support of their position, which was rejected by both the majority of writers and almost all lawyers. Indeed, the reasons for using a pseudonym can be very different, including very respectful ones, for example, the dissonance of the author's real name, its coincidence with the name of another author, the official position of the author, etc. But in principle, this should not matter, since we are talking about the creator's free choice of the designation of his connection with the work. The ban on a pseudonym is incompatible with the freedom of creativity.

The law does not provide for any conditions or procedure for acquiring the right to a pseudonym. The term and extent of the use of a pseudonym are also determined by the author himself. He can release his first works under a conditional name, and later perform under his real name, as, for example, A.P. Chekhov. The author can designate by a pseudonym some part of his works, for example, works of a certain genre.

The law prohibits without the consent of the author to make any changes to the way the author chose to designate his name, including when he used a pseudonym. A pseudonym, like the real name of the author, should not be distorted. Disclosing the pseudonym of the author without his consent will be a special violation. Such violations occur in practice, but the current legislation, in fact, does not contain any sanctions for this violation. The author can really protect his right to a pseudonym only when it is possible to stop the impending offense. After it has been committed, the author, at best, can be given an official apology, as well as compensated, at his request, for moral damage. Sometimes, however, the need to disclose a pseudonym may arise due to the fact that an article or note published in the press is clearly libelous or offensive. This can be done, but only when the relevant request has been received from the court in connection with the case under its proceedings. In other cases, the editorial office is obliged to keep the source of information secret and is not entitled to name the person who provided the information on the condition of not disclosing his name, including by disclosing a pseudonym (Article 41 of the Law of the RSFSR *0 mass media).

In some cases, the right of an author to act under a pseudonym may be restricted. So, it is hardly permissible to use such a pseudonym that violates the norms of morality or is offensive. Equally, an author cannot choose a pseudonym that is clearly misleading to the public, for example, when it coincides with a name under which another author has long been using. In both cases, the author may be denied the protection of his rights with reference to Art. 10 of the Civil Code of the Russian Federation, which prohibits the abuse of civil rights.

The right to an author's name can be exercised by publishing a work without indicating the name of the creator of the work, i.e. anonymously. In this case, the will of the author is aimed at not linking the work he created with his name. Sometimes, however, the name of the author is not indicated due to the established procedure for publishing certain works, for example, leading articles in newspapers and magazines, articles in reference books and dictionaries, etc. The author preparing the relevant material must be warned in advance that his name will not be indicated when the work is published. He may disagree with such a provision and prohibit the use of the work created by him without indicating his name. If the author does not object to the publication of his work anonymously in connection with the established tradition, this means that he has exercised the right to the author's name.

The publication of a work without indicating the name of the author does not in any way mean that the creator of the work renounces authorship of it. The right of authorship, as well as all other copyrights, is reserved by the creator of the work and can be used by him in a general manner. The only problem is to prove authorship of an anonymously published work. It is usually endorsed by the organization that used the work and who usually knows the real name of the author. Like a pseudonym, anonymous can be disclosed without the consent of the author only at the request of the court. Sometimes, however, the question arises of the possibility of publishing the name of the creator of an anonymous work after the death of the author. The heirs or a specially appointed person shall acquire the right to protection of the author's name. Therefore, if the author has not left any specific instructions on this score, the issue is decided at the discretion of the above persons.

Adjacent to the problem of the author's name is the issue of the author's ability to dedicate the entire work to certain persons, events or dates, which is not regulated by law in any way. Often, dedication is associated with the author's creative intention or helps to better understand the main content of the creative work. In practice, users of works sometimes object to the inclusion of such dedications in a work. In the conditions of unsettledness of this issue, it is resolved by reaching the mutual consent of the author and the user of the work. In order to avoid unnecessary disputes, it is advisable to stipulate this issue in the author's agreement in advance.

Along with the direct creators of works, the right to designate their name is used by enterprises, institutions and organizations, on the official assignment of which the work was created (clause 3, article 14 of the Law of the Russian Federation “On Copyright and Related Rights”). Thus, an educational institution or scientific institution may insist that their name be indicated on works created by their employees as part of the work assigned to them.

One of the first famous translators was Vasily Andreevich Zhukovsky. More than half of what he wrote are translations from ancient Greek, German, English and other languages. It was he who opened Goethe and Schiller to the Russian reader. The translated works of Zhukovsky the poet are perceived as masterpieces not only of translated literature, but of literature in general. They rightfully deserved worthy attention among readers, some of the works turned out to be stronger than the originals. According to Vasily Andreevich, the reason for the success of his translations lies in the fact that he himself liked those works for which he undertook.

At the turn of the 19th and 20th centuries, Vikenty Veresaev presented the reader with translations of ancient Greek works: the Iliad, the Odyssey, Sappho, etc. Veresaev's translated works are almost better known to the reader than his own.

Akhmatova, Balmont, Blok and other poets of the Silver Age translated a lot and varied, French, English. Flaubert's Madame Bovary and Maupassant's short stories performed by I. Turgenev are popular. This Russian writer was fluent in French and English. Another writer of the 19th century who translated world classics is F. Dostoevsky. Popular among readers is his translation of Balzac's Eugene Grande.

From the point of view of translation activities, Vladimir Nabokov is interesting. This is a bilingual writer, whose authorship belongs to works and languages. He translated a lot from Russian into English, for example, "The Tale of Igor's Campaign" and his own novel "Lolita".

The German anti-fascist writer Heinrich Belle translated many of the works of English writers into German. Together with his wife, they discovered the works of Salinger and Malamud for Germany. Subsequently, the novels of Bell himself were conveyed to the Russian-speaking reader by the Soviet writer Rita Wright-Kovaleva. She also owns translations of Schiller, Kafka, Faulkner.

The modern writer Boris Akunin, who gained fame among the Russian reader as the author of works of the detective genre, is no less famous for his translations. His translation has been published by Japanese, English and French authors.
