The head of the Federal State Institution “Unified Settlement Center of the Ministry of Defense of the Russian Federation”, duly notified of the place and time of the court session, did not arrive at the court session. From the head of the 1st Department of the Clothing Service of the Central Office of the Ministry of Defense of the Russian Federation, duly notified of the place and time of the consideration of the application, the court received a written request to consider the civil case without his participation.

The applicant did not give his consent to the exclusion from the lists of personnel of the military unit without making a final settlement with him of the prescribed types of allowances. At the same time, contrary to the requirements of paragraph 16 of Article 34 of the said Regulations on the procedure for military service, the final settlement of the established monetary allowance with Repin A.G. made by transferring funds to his current account only on December 16, 2011, that is, after his exclusion from the lists of personnel. On the same date, the one-time monetary allowance established for him by the head of the General Staff of the General Staff of the Armed Forces of the Russian Federation upon dismissal from military service and a one-time monetary reward for conscientious performance of military service duties for 2011 were transferred to him. The final settlement of clothing allowance with the applicant has not been made to date.

It was also established at the court session that the military personnel of the General Staff of the RF Armed Forces are on financial allowances in the Federal State Institution "Unified Settlement Center of the Ministry of Defense of the Russian Federation", and on clothing support - in the 1 Department of the Clothing Service of the Central Office of the Ministry of Defense of the Russian Federation.

Since the final settlement of monetary allowance and the above lump-sum additional payments with the applicant was made due to circumstances beyond his control only on December 16, 2011, the court, taking into account the requirements of paragraph 16 of Article 34 of the Regulations on the procedure for military service, which provides for the provision of a serviceman with all the required types of allowance for day of exclusion from the lists of personnel, in order to restore the rights and legally protected interests of the applicant, he considers it necessary to recognize as illegal the actions of the head of the General Staff of the General Staff of the Armed Forces of the Russian Federation, related to the issuance of order No. , to oblige the head of the General Staff of the General Staff of the Armed Forces of the Russian Federation to amend the order of November 29, 2011 No. 302 in terms of excluding him from the lists of personnel of the department from December 14 to 16, 2011, to oblige the head of the Federal State Institution "Unified Settlement Center of the Ministry of Defense of the Russian Federation" to pay him a monetary allowance until December 16, 2011, to oblige the head of the 1st department for providing the Clothing Service of the central apparatus of the Ministry of Defense of the Russian Federation to make a final settlement with him with clothing allowances until December 16, 2011, thereby satisfying the stated requirements of Repin A.G. in this part.

On the same grounds, the court refuses to satisfy the applicant's claims to recognize the order of the head of the GOMU of the General Staff of the Armed Forces of the Russian Federation dated November 29, 2011 No. 302 in terms of excluding him from the lists of personnel of the department as illegal and inoperative from the moment of its issuance, imposing duties on the head of the GOMU of the General Staff of the Armed Forces of the Russian Federation of the Russian Federation to restore him in the lists of the personnel of the department and to recalculate all types of allowances as of the date of the court decision, to assign the responsibility to the head of the Federal Budgetary Institution "Department of Financial Support of the Ministry of Defense of the Russian Federation for the City of Moscow and the Moscow Region" to recalculate his monetary allowances, including a one-time monetary reward for conscientious performance of military service duties, as of the date of restoration in the lists of personnel of the department.

As for the applicant’s argument that he has not been provided with clothing items to date, the court comes to the conclusion that in this case, the restoration of the rights and interests of the applicant protected by law is possible by imposing a duty on the head of the 1st department for providing the Clothing Service of the central apparatus of the Ministry of Defense of the Russian Federation to make the final settlement with him of clothing allowances by the new date of exclusion from the lists of personnel of the department.

Since, as noted above, the military personnel of the General Staff of the Main Staff of the RF Armed Forces on clothing are in the 1st department for providing the Clothing Service of the central apparatus of the Ministry of Defense of the Russian Federation and the head of this department is entrusted with the obligation to make the final settlement with the applicant of clothing allowance, the court finds no grounds to satisfy his demands for the assignment of duties to the chief of the General Staff of the Armed Forces of the Russian Federation to determine the military command body that will provide him with clothing.

In accordance with Article 98 of the Code of Civil Procedure of the Russian Federation, the party in whose favor the court decision was held is awarded to reimburse all the court costs incurred in the case on the other side.

Since the statement of Repin A.G. is subject to partial satisfaction, then the court costs incurred by him to pay the state fee when applying to the court with an application in the amount of 200 rubles are subject to recovery in his favor from the Federal State Institution "Unified Settlement Center of the Ministry of Defense of the Russian Federation".

With the formation of the Workers 'and Peasants' Red Army (RKKA), a new stage began in the history of organizational and mobilization bodies. So, on May 8, 1918, the All-Russian General Staff (Vseroglavshtab) was created, which became the highest military body in charge of accounting, training and mobilization of those liable for military service; formation, organization and combat training of the Red Army units. On July 29, 1941, by order of the People's Commissar of Defense, the structures involved in the organization, mobilization, conscription and recruitment of troops at the General Staff were transferred to the established Main Directorate for the Formation and Staffing of the Red Army Troops (Glavupraform).
