Schools for children with deviant behavior(does not comply with accepted moral and legal standards - Ed.) is what you need. We have very few of them, but they are really good, excellent specialists work in them, there is a different load there ... And, of course, within the framework of the whole country, a body is needed that would deal with difficult children.

Why did the idea of ​​the appearance of juvenile justice in Russia cause such rejection?

The main negative comes from the church, which considers it impossible to interfere in the affairs of the family, and, accordingly, juvenile justice is a threat to the family as the fundamental principle of everything. From my point of view, there is a substitution of concepts. Why is juvenile justice necessary - these are terrible aunts from guardianship who check the contents of your refrigerator and the number of sleeping sets of linen? The concept of "children's rights" is different. I don't care what it will be called - juvenile justice or not, but what annoys me immensely, and what is one of the main problems of our society - is the lack of juvenile judges. You come to court and see a list of 50 cases scheduled for today: invalidation of the sale and purchase agreement, division of property, insurance payment... and determining the place of residence of the child. And you realize it's impossible: the judge, who's just divided up the garage and established ownership, moves on to the next case: "So, boy, now you." There is no need for separate courts - why not single out a specific person, a narrow specialist on this issue, who, from a legal and psychological point of view, will be ready to sort it out objectively? ..

I heard that our valiant deputies proposed introducing criminal liability as early as 12 years old?

And even with 10. I am categorically against it, because it happens that even 14-year-olds, who are subject to criminal liability, are, in their minds, a child-child, the brains of a three-year-old. When making a decision, everything must be taken into account - from physiology to mental development. I think that the age of criminal responsibility should not be lowered. And 14 years is not enough for that. On the contrary, I would raise the age limit to 16 years.

I do not agree that our program can be called "similar", and reflecting the same goals and objectives as the rest of the court shows. How is everything going on in them? Get up, the court is coming, sentenced to this and that for that. Everything is very precise according to the law, no one deduces any morality. We have a little bit different, we have the main thing - a dialogue between an adult and a child, a dialogue between a judge and a child, a dialogue between a mother and a child ... And why is there a demand for judicial topics on the TV screen? Perhaps because society is beginning to realize its legal illiteracy, perhaps because court hearings look like mini-detectives...

Or because in real judicial practice it's not like that at all, TV sweetens the pill a lot?

In real life, of course, you don't judge like that. On the screen, everything happens as it should ideally. The viewer, seeing a benevolent picture on his TV, thinks: “Oh, it’s not so bad, it turns out.” And getting into a real court, he receives at least an emotional shock from the disgrace that is happening in our courts ...

In the program, Victoria acts as a judge, but by specialization and by nature she is a lawyer. Does the program “On Juvenile Affairs” consider real cases?

Partially - yes, those that were once already considered, but we by no means repeat the decisions of those courts - we issue our own. We are looking for a reason, a fundamental principle in every case: what little man prompted, how it all began, what worked there? On the show, I act as a judge, but by my specialty - and by nature - I am a lawyer. Finally, I tell the child some parting words that are by no means spelled out in the script, I say what I thought of by the end of the meeting, what do I now, in this moment he wanted to say.

Have you chosen the specialization "lawyer" already studying at the Faculty of Law?

From the third grade - both in the fifth and in the eighth - I wanted to be an investigator, and always with a gun. You remember this wonderful series - "Experts are investigating" (moreover, in that trio I was equal not to expert Zina Kibrit, but to investigators Znamensky and Tomin). No arguments like that the investigator is male profession, didn't work for me. But by the third or fourth year of study at the university, after practice in the prosecutor's office and the court, it came to the realization that the investigator is not quite the same.

There are people behind me, I can't do this to them. There is a duty, there are obligations that I personally cannot cover for myself. In such cases, you gather your will into a fist and go. And I packed up and left. Probably, colleagues will not agree with me, but I believe that a lawyer should be born, and not acquire a profession. I meet a lot of people who I don’t want to call colleagues ... Behind my back are people, their human pain for me, but they don’t come to me with joy, no idle talk for a red word. In the first years of work, I simply lived with every business, passed each one through my heart, the client called me 154 times to clarify some trifle ... Now I have learned not to burn to the ground every time, but human value remains above all for me. With any person with whom I start working, I enter not only into a formal relationship. Issues of prevention of neglect, delinquency and juvenile crimes were discussed at the collegium in the city prosecutor's office

In the prosecutor's office of the capital, under the chairmanship of the first deputy prosecutor of the city of Moscow, Oleg Kamshilov, a board meeting was held, at which the state of legality and prosecutor's supervision over the execution by bodies and institutions of the system for the prevention of neglect and juvenile delinquency of legislation aimed at protecting children in socially precarious position as well as the prevention of crimes committed by and against minors.

The meeting was attended by: members of the Board of the Prosecutor's Office of Moscow, heads structural divisions office of the prosecutor's office of the city and their deputies, prosecutors administrative districts, inter-district prosecutors, prosecutors of specialized prosecutor's offices of the capital.

During the discussion, a positive trend was noted in reducing juvenile delinquency by 11.4% (from 595 to 527 crimes) over 8 months of the current year. However, of particular concern is the increase by 38% in the number of serious crimes committed by minors (from 134 to 185), including theft from homes (from 6 to 30), murders (from 1 to 4), robberies (from 58 to 78).


The number of crimes committed against children has almost halved (from 2194 to 1209), of which the largest part is crimes against sexual integrity and sexual freedom of the individual (176 crimes), including when using the Internet information and telecommunication network.

For 8 months of 2016, 488 crimes against property were committed against minors, which is 40.3% of the total number of crimes registered against them.


The results of the inspections carried out testify to the presence of violations in the activities of the organs of the prevention system. So, in 2015, prosecutors identified 3398 of them (APPG - 2842), in the first half of 2016 - 2700 (APPG - 1880). In order to prevent them in 2015, prosecutors made 839 submissions (APPG - 703), for 6 months of 2016 - 495.

At the same time, it is premature to draw a conclusion about the effectiveness of the measures taken, the timely elimination of violations of laws and the circumstances that contribute to them, by the supervised bodies of the prevention system.


The problem of suicides (attempted suicides) of minors and the search for missing children, as well as the timely detection by the organs of the prevention system, primarily educational and medical organizations, adolescents with tendencies to suicidal behavior and unauthorized leaving of the family and boarding schools.

The results of the audit of the activities of the departments for juvenile affairs of the Main Directorate of the Ministry of Internal Affairs of Russia for the city of Moscow, as well as the analysis of the work of other services of the internal affairs bodies in this area indicate inefficiency preventive work conducted with minors and families of this category.


In addition, noteworthy is the fact that law enforcement of Moscow, the powers to establish and bring to criminal liability under Art. 150 of the Criminal Code of the Russian Federation of persons who involved minors in criminal activity (the number of such crimes decreased from 19 to 13). Law enforcement practice of criminalizing adults for inciting teenagers to consume drugs, psychotropic substances and their analogues in Moscow is single.


Investigators fail to notify territorial commissions for juvenile affairs and protection of their rights (hereinafter referred to as KDNiZP), divisions and departments for juvenile affairs of internal affairs bodies and educational organizations on initiation of criminal cases against minors. Submissions in the order of Part 2 of Art. 158 of the Code of Criminal Procedure of the Russian Federation are submitted at the end of the preliminary investigation and, as a rule, only to the internal affairs bodies. This does not allow the bodies of the prevention system to take timely comprehensive measures to eliminate the circumstances that contributed to the commission of socially dangerous acts by minors.
